In case of rescheduling, the applicable terms and conditions will be those in force at the time of confirming your new reservation. For example, if your rescheduled trip was confirmed as of July 25, 2023, the following Terms and Conditions will apply.

  1. Acceptance and availability of the Terms and Conditions

By accepting this contract, the User declares the following:

These Terms and Conditions regulate the generic use of the website. The effective contracting of the services offered by Vermilion will be governed by its specific conditions, in accordance with current legislation.

The making by the User of reservations or purchases of products or services from those suppliers or organizers of combined trips that the User chooses, will be subject to the particular terms and conditions that such suppliers or organizers of combined trips establish for each case.

The information on offers, products or services, prices, routes, distances, characteristics and any other relevant data and information about the products offered through the website corresponds to that provided to us by the tourism providers (hotels, wholesalers , reservation centers). The accuracy of said information comes from the operators that generate it. Each party involved in the contract will be responsible for their respective area of management.

The services offered through the website www.vermilionroutes.com are for personal, non-commercial use only. Therefore, you are not permitted to resell, use, copy, monitor, display, download or reproduce the content, information, software, products or services available on our website for any commercial or competitive activity.

  1. Limitation of liability

  1. Payments and purchasing process

The User must make the payment for their package trip according to the instructions offered on our website. In general, in order to confirm a package travel reservation, the User must make a deposit at the time of reservation. The rest of the amount to cover the total agreed price must be paid no later than 60 days prior to the start of the corresponding trip. Reservations made 60 days or less in advance must make full payment at the time of reservation.

If Vermilion does not receive payments within the indicated periods, it reserves the right to treat said reservation as a “cancellation by the Client” and therefore the penalties and expenses specified in the “Other Cancellation by the Client” section will apply.

Additionally, it may not be possible to make changes to your reservation once it is confirmed, so please review the information before finalizing your purchase and, should you require a change later, please note that the “Changes” section of this page will apply. these Terms and Conditions

  1. The price

The price of trips contracted on the Vermilion website is established based on the services and dates selected by the User, and will depend on the number of people included in the reservation.

It is the User’s responsibility to review the “price includes” and “price does not include” sections of the offer before completing the purchase process. These detail exactly all the services included in the reservation.

Tourist tax: in certain hotel establishments they may require the payment of a fee/tax that must be paid at the establishment itself. Consult in each case according to destination.

  1. Cancellation Policy

Partial cancellation of a reservation is not allowed. In the event that the client(s) wish to cancel the reservation, the cancellation policy in this section will apply. In this sense, Vermilion incurs several non-refundable expenses before canceling and therefore the penalties are precisely proportional to these non-recoverable expenses.

Products/services added to the trip purchased after the booking date cannot be canceled less than SIXTY (60) days before the trip.

Cancellation less than SIXTY (60) days before the trip of the products/services added to the trip purchased after the date of the reservation will entail a penalty of ONE HUNDRED PERCENT (100%) of the amount of the canceled added service .

10.1 Cancellation by the Client

Once a partial or full payment has been made, cancellations will only be accepted in writing. In the event that the User wishes to request the cancellation of their reservation, they must send their request through our contact form available Here.

Your cancellation request notification will only take effect once it is received in writing, and in the event that receipt takes place outside the operating hours of our Customer Service team, it will take effect from the next business day (check the operating hours in “Contact” section of our website).

If there are specific cancellation conditions for a specific trip, they will be indicated in the “conditions” section of the offer. If there are no specific conditions, the cancellation fees established below will apply.

At any time prior to the start of the package trip, the traveler may terminate the trip and, in that case, the cancellation policy and applicable cancellation fees for clients who wish to cancel their trip voluntarily will be:

  • If the cancellation occurs SIXTY (60) or more days before the start date of the trip, the amount corresponding to the deposit paid will be deducted as a penalty.
  • If the cancellation occurs FIFTY-NINE (59) or less days before the start date of the trip, SEVENTY-FIVE PERCENT (75%) of the total amount of the trip will be deducted as a penalty.

Without prejudice to the eventual contracting of the coverage provided for in the following clauses. Penalties and management expenses will be deducted from any collection that would have been received by Vermilion.

If the reasons for your cancellation were covered by the insurance company’s terms and conditions, you will be able to claim these charges from them.

10.2 Cancellation by Vermilion

The cancellation of the trip, for any reason that is not attributable to the consumer, gives the right to terminate the contract with the rights provided for in these Terms and Conditions of Use.

Vermilion may cancel the trip by refunding the customer all payments made through a non-refundable travel credit or wallet. Likewise, there will be no obligation to compensate the client in the following cases:

  • When the cancellation is due to the number of registered people being less than what allows the combined trip to be organized. In this case, Vermilion will communicate the cancellation to the User without undue delay.
  • When the cancellation of the trip is due to the impossibility of executing the contract due to unavoidable and extraordinary circumstances and the traveler is notified of the cancellation without undue delay before the start of the package trip.

The Vermilion travel credit is a non-refundable virtual voucher that can be used on any trip published on our website and whenever the Client wishes (the Vermilion travel credit does not expire). If the amount of the trip is less than the available credit, the difference will remain available in the User’s “Vermilion Wallet”, ready to be used for another trip. On the other hand, if the amount of the trip is greater than the available credit, the difference must be paid by the Client following the payment conditions defined in the “Payments” section.

In the event that the Client decides to reject the use of Vermilion travel credit as a refund method, they may opt for a cash refund. The cash refund implies the application of the penalty of 75% of the trip amount in accordance with the “cancellation by the client” policy.

Standard Protection in case of closure of borders and/or airspace of the destination country.

In the event that the Client cannot travel due to any of the situations mentioned below, they will have the option of making a free rescheduling of their trip using a Vermilion travel credit and no penalties or administration costs will apply:

  • Closure of borders to foreign tourism – includes the situation of travel restriction to the destination country, where the Government has issued a resolution prohibiting entry for foreign visitors.
  • Government restrictions of the country of origin – includes the situation of travel restriction from the country of origin, where the Government has issued a resolution prohibiting departure for the relevant destination country.
  • Mandatory quarantine at destination – exclusively includes the situation where the Government has issued a resolution to establish a mandatory quarantine at destination and that cannot be avoided by an alternative measure (negative COVID-19 test, for example)

  1. Modifications

12.1 Modifications and errors in information by the Client

In the event that the User wishes to request a modification in relation to the dates or people included in their reservation, they must send their request through our contact form available here or call our Customer Service team at the telephone number provided. On our website.

Vermilion cannot guarantee that the requested changes can be made in all cases, as they depend on external factors such as, for example, the availability of our suppliers. However, the Vermilion team will do its best to make them happen.

Likewise, both the correction of the identification data of people in one or more reservations and any other change could imply the application of increased rates or extra expenses incurred by Vermilion or imposed by any of our suppliers that will be transferable to the Client. Certain agreements, in particular the amounts paid for the air component, may not be modifiable after confirmation and any alteration or cancellation implies that the Client must assume the total charges plus the modification expenses mentioned above.

12.2 Modifications by Vermilion

Before departure, Vermilion may make changes that are necessary for the successful completion of the package trip and that are not significant. The necessary changes are considered significant if they prevent the achievement of its purposes according to its general or special characteristics.

In the event that Vermilion is forced to make significant changes, it will immediately inform the User. The latter may choose between accepting the modification of the contract that specifies the variations introduced and their impact on the price, or terminating the contract. The consumer must communicate the decision he or she adopts to the agency within three days after being notified of the modification. If the consumer does not communicate his decision within the indicated period, it will be understood that he chooses to terminate the contract.

  1. Failure to present at departure

There will be a failure to appear at departure if the consumer does not communicate his or her desire not to carry out the trip and does not appear at the time and place scheduled for departure.

In this case, you lose the right to the return of the amounts delivered and remain obliged to pay those that are pending payment.

If the non-presentation occurs due to force majeure, the consumer will have the right to a refund of the amounts delivered, except for the management costs and the costs of canceling the reservation at that time. In this case, the consumer must provide the necessary evidence to prove the force majeure situation.

For these purposes, and with a non-limiting nature, the death, accident or serious illness of the consumer or of any of the people with whom he or she lives or any similar event that prevents him or her from participating in the trip and notifying the agency that impossibility before departure.

  1. Voluntary changes and early returns

In the event that the client, once the trip has started, voluntarily requests any modification of the contracted services (for example: additional night’s stay, hotel or flight changes), the prices of the tourist services may not correspond to those published in the offer that gave rise to the contract and the Client must absorb any difference in rate that arises as a result of the change.

In this case, transfers between hotels will be the responsibility of the client, and the client must also pay the management costs, as a result of the processing of the new reservation made, or the change of the requested flight.

In the event of abandonment of the establishment before the contracted date due to force majeure, Vermilion does not undertake to make any refund.

  1. Passports, visas and vaccinations

It is the User’s responsibility to verify that the personal and family documents of all passengers (including children) are in order and meet the validity period. In the case of the passport, visa or national identity document, the User must verify the requirements demanded by the regulations of the country they are going to visit. Obtaining a passport or any other required requirement will be at your own expense.

If the documentation is rejected by any authority or entry to the country is denied for not meeting the requirements or for not possessing it, Vermilion will not be responsible for additional expenses nor will it refund the cost of the trip. Minors under 18 years of age must carry written permission signed by their parents or guardians, in anticipation that it may be requested by any authority.

PASSPORT AND VACCINATION NOTICE: On all national and international trips, you must verify the admission requirements, passport validity (some countries require passport validity up to 6 months after the return date) and vaccination, established by the authorities of each one. of the destination and/or stopover countries. Consult the official websites of the Immigration and Health agencies of your country and of the destination and stopover countries, as well as the airline requirements. If exit or entry to the country of destination or transit is denied by the authorities, for reasons particular to the traveler due to lack of the required requirements, due to a defect in the required documentation, and/or due to failure to be the carrier of the same. , Vermilion declines all responsibility for events of this nature, causing any expenses incurred by the traveler and applying the no-show policy at departure.

Documentation necessary for your trip.

You must include the name and surname of the passengers as they appear in their documentation (DNI, Passport or Residence Card/NIE).

It is the responsibility of each passenger to ensure that they have valid travel documentation that meets the requirements of the airline, immigration and the authorities of each destination.

Please note that:

  • A valid travel document is required for all traveling passengers (including infants and minors).
  • If the visa is applicable, any child/infant must travel with the adult in the visa photograph.
  • Resident cards, driving license, family books, maritime identification books, a police report (issued in case of loss of the travel document or theft), military identification cards, among others, are NOT will be accepted as valid documents. Expired or damaged photo IDs will not be accepted on any flight.
  • Travel document details of passengers (including children and babies) must be entered during the online check-in process. On all journeys, passengers must present their valid travel document and boarding pass online at the airport security area and at the boarding gate.

Minors:

As a general rule, minors travel accompanied by an adult. Vermilion will not manage trips for unaccompanied minors.

Loss or damage to luggage

The airline is responsible for the damage caused in the event of destruction, loss or damage to checked baggage when the event that caused the damage occurred on board the aircraft or while the checked baggage is in the custody of the company.

Vermilion recommends that the User wish to make a claim for non-execution or incorrect execution of the Contract to first contact the hotel or supplier on site, stating their complaints within 24 hours of arrival.

  1. Referral Program
  • Participants in the Vermilion Referral Program must be 18 years of age or older.
  • Referral credits and discounts are non-refundable.
  • Credits from people who refer Vermilion are valid for 24 months from the date they are earned (from the moment the referred friend pays the deposit for their first trip with Vermilion using a referral code) .
  • The credit will be issued to the sender a few hours after the referred friend has paid the deposit for their first trip.
  • Referral credit can only be redeemed by a new customer during the period from day one of creating your Vermilion account to day 90 at 11:59:59 p.m. From that day on, you will no longer be able to benefit from this promotion, regardless of the date on which you received the invitation with the referral code.
  • Referred friends must be new customers who have never booked or traveled with Vermilion before.
  • Referred friends cannot share a reservation or room with the person who recommended them.
  • The credit can only be used by one person per room on each reservation you make with Vermilion.
  • Each participant will be able to share their referral code as many times as they wish during the duration of this program.
  • Referred friends must provide the referral code at the time of booking to receive the discount and generate a 100USD credit.
  • If a referred friend books through the call centre, you must provide the agent with the referral code of the person who referred you when making the booking.
  • Referred friends can only use your referral code for their first booking. If this reservation is canceled later, the code cannot be reused.
  • All referral credits can be combined with each other and any other credits in your Vermilion account and can be used on any future reservations.
  • Referral credits can only be used to make a new reservation. They cannot be used to add or change an insurance policy.
  • Each referral credit awarded must be applied in its entirety to a single reservation. Once the balance of the reservation is paid in full, any remaining amount will be forfeited and cannot be transferred to another reservation.
  • People traveling in private groups cannot participate in this program.
  • The reference codes generated from this promotion are personal and non-transferable, and in no case may they be exchanged or altered. It is strictly prohibited to reproduce, make available to the public, modify, sell or distribute said reference codes in any way.
  • Vermilion reserves the right to block and/or cancel without prior notice all those codes that, in the opinion of the organizing entity, have been generated fraudulently. Vermilion may disable access to the beneficiary account of said codes, in those cases that do not comply with the company policy, and/or defraud, alter or disable the proper functioning and normal and regulatory course of the promotion; In addition, you may exercise the corresponding legal actions.
